POLICIES

CONDITION AND RETURN OF VEHICLE

Standard terms and conditions apply to all vehicle rentals from Broadway SuperCars LLC. All renters must comply with these terms.
Under this agreement, the renter and the rights of Broadway SuperCars LLC shall remain in effect from the start of the rental period until the vehicle has been returned. The rental vehicle must be returned to Broadway SuperCars LLC in good order and without any damage, at the agreed upon time and date.

Any damaged not reflected on the rental vehicle inspection prior to the rental period will be regarded as new damage. New damage will be the sole responsibility of the renter.

Broadway SuperCars LLC maintains the right to terminate this agreement at any time by notice (verbal or written), where upon the renter shall return the vehicle to Broadway SuperCars LLC forthwith. If the terms of this agreement are not complied with, Broadway SuperCars LLC is entitled to take possession of the vehicle at any location. All costs incurred by Broadway SuperCars LLC to retrieve the vehicle will be the sole responsibility to the renter.

SECURITY DEPOSIT POLICY

Security deposits are mandatory for all rented vehicles. A damage/security deposit is required in order to rent a vehicle. The amount of the deposit ranges between $2,500 and $10,000 depending on the particular vehicle and the timeframe of your rental. All renters must provide a damage deposit in the form of a credit card authorization. We accept all major credit cards and cash. In the unfortunate event a vehicle is returned with damage present, we charge the cost of damage against the damage/security deposit.

We only process an Authorization hold on your card of the Security Deposit amount. An authorization hold is a pending charge on a payment account and is not a true charge. We do not actually charge the card (deduct any funds). The Authorization hold will fall off and is released back to your bank account (thus rendering your balance available again) anywhere from 1–7 days after the initial transaction date (Date of reservation).

The damage/security deposit is indeed fully refundable if the car is returned in the same condition in which it was rented and no damage is present.

Each Renter understands that if there is any damage to the vehicle upon the return, the security deposit may be used to cover any charges resulting in the loss of use of the vehicle, any damages to the vehicle that insurance will not cover and/or the insurance deductible. Renter agrees that the security deposit can and may be used for any damages, excess fuel charges, excess mileage charges, and renter agrees renter will not dispute such charges if they are incurred. Renter agrees that in the event of damage, it will be renter’s responsibility to recover any monies billed against renter’s security deposit from the insurance company.

USE OF VEHICLE

Under these terms, any error incurred at the fault of the renter is subject to a $500 call out charge and a charge of $3 6per mile traveled. Examples of renter error include, but not limited to, keys locked in car, flat battery due to lights being left on, flat tires, etc. A free call out will only be issued upon mechanical breakdown.

Under no circumstances should the renter use a rental vehicle for business purposes, conveyance (people or goods), to propel or tow another vehicle, to partake in any motor sport, or engage in any high-risk activity. In addition, the rental vehicle may not be used in an area where there may be a risk or incidents of civil unrest, or outside of the borders of the United States.

The renter shall use the correct fuel and oils as indicated by the vehicle manual, check the oil, water, and other fluids regularly, and shall contact Broadway SuperCars LLC immediately if any damage is detected on any part of the vehicle. Furthermore, the renter agrees to make adequate provision for the safety and security of the vehicle, including, but not limited to, keeping the vehicle properly locked, secured, and making use of any anti-theft device provided by Broadway SuperCars LLC. It is also the responsibility of the renter to keep the keys of the vehicle under his or her control at all times.

Failure to comply with the aforementioned terms will constitute a breach of the agreement, resulting in the renter’s deposit being forfeited. No exceptions will be made.

THE DRIVER

During the rental period the vehicle may not be driven by any person other than the renter or additional driver mentioned on the page 1 of this agreement.

The renter warrants that the vehicle will not be driven by himself or any other person whose blood alcohol concentration exceeds the legal limit, or whilst under the influence of intoxicating liquor or narcotic.

In addition, the driver of the vehicle will have a valid drivers license, will comply with all applicable laws, and will comply in all respects with the provisions of this agreement.

If the vehicle is driven by anyone other than the renter, the renter will remain liable to Broadway SuperCars LLC as if he or she had been the driver.

LIABILITY FOR DAMAGE AND THEFT

During the rental period, the responsibility of the vehicle rests solely on the renter. The renter will be responsible for any loss or damage done to the vehicle and any expenses incurred in recovering the vehicle.

The renter liability shall be limited as follows:

INSURANCE

All renters must carry a form of insurance to cover damages to the vehicle in the event of an accident. Allowable coverage must be in one of the following forms:

Existing Coverage

If you already have an existing insurance policy on a personal vehicle you own or lease, you can use this same policy to cover your rental vehicle. We will contact your insurance company to verify that you have adequate coverage in place. If your coverage is insufficient, we will require all drivers to purchase additional coverage with their insurance company prior to renting. (Fortunately, it does not matter what car you drive personally. As long as you have insurance with full coverage and in good standing, your carrier will cover damages.). Out-of-state renters are required to maintain full-coverage insurance (liability, comprehensive, and collision).

ADDITIONAL DRIVER POLICY

Additional drivers may be listed as “authorized drivers” as long as they can provide their own insurance, or they are also listed under the same policy that is being used to rent the vehicle. Each additional driver must complete a rental application and will be subject to the same age, licensing, and driving-record restrictions as the primary renter. Unauthorized drivers are not allowed to drive the vehicle under any condition.

RETURN TIMES

Broadway SuperCars LLC offers a 30-minute grace period as part of your scheduled return time. If you are unable to return the vehicle on time or within the grace period, you may be subject to additional rental fees. Please plan accordingly so that you can return the car on time, as other renters are scheduled to drive after you. Late returns can affect our ability to deliver the vehicle on time for the following renter.

CANCELLATION POLICY

If you reserve a vehicle, we will authorize your credit card for an agreed portion of the full cost of the rental/driving package. If you need to cancel your reservation within 7 days of your rental date, there will be acancellation fee of 50% of the total rental cost, meaning you will only be refunded half initial amount you were charged. If you no-show at the time of your reservation without notifying us ahead of time, you will be charged a cancellation fee of 100% of the total rental cost.

We do not mean to sound unaccommodating, but the day you rented the vehicle will now become an empty slot and we have other people who may have wanted the date of your reservation.

When you reserve a vehicle, we will place a hold on your credit card for 50% of the total rental cost. If you need to cancel or reschedule, the following fees will apply:

Cancellation / reschedule within:

At least 20 days before rental: $100 fee.

At least 10 days before rental: $250 fee.

At least 7 days before rental: 50% of the hold (rental fee).

Less than 72 hours before rental: 100% of rental fee.

Please note that all driving experiences are not subject to a refund but can be transfer to a person of your choice for the reserved date.

On major holidays, events, and special occasions, Broadway SuperCars LLC requires a 30-day notice of cancellation for a full refund of your deposit. During these specials occasion dates, and if you cancel 7 days or less before your rental, you will be charged for 100% of the rental.

In the event of an unforeseen mechanical failure during or prior to a rental, we will make every effort to repair or replace your vehicle with a similar or better model at no additional cost to you. In certain circumstance where Broadway Supercars cannot find an equitable exchange vehicle, renters will be issued a voucher with an equivalent dollar value to the percentage of the rental period not utilized that can be used towards a future rental.

At our sole discretion, we may waive or reduce cancellation fees under special circumstances, or apply them as account credit, which may be applied to your future rentals with us.

All refunds of any kinds will be processed within 30 days.

REFUND POLICY

We do not offer refunds for gift certificates or vouchers purchased from any social media sources. Broadway SuperCars LLC does not accept charge backs. We consider credit card charge backs to be fraud if you have made no reasonable effort to work with us to resolve any problems with your purchase. The renter is responsible for charge back fees consisting of attorney’s fees, fees for collection agencies or third-party intervention. If the renter charges back fraudulently, client will owe charge back fees plus amount owed.

In the event of an unforeseen mechanical failure during or prior to a rental, we will make every effort to repair or replace your vehicle with a similar or better model at no additional cost to you. In certain circumstance where Broadway Supercars cannot find an equitable exchange vehicle, renters will be issued a voucher with an equivalent dollar value to the percentage of the rental period not utilized that can be used towards a future rental.

WEATHER POLICY

Unfortunately, we cannot control the weather, but we try to be understanding and flexible when the weather isn’t cooperating. If you’re unable to use the vehicle during your rental period, we may (at our discretion) be willing to reschedule your rental for another day at no additional charge. This policy is not to be abused – if it’s lightly raining or cloudy, we’ll expect you to pick up the car.

The same applies while you are in possession of the car. If you are unable to use or return the vehicle due to unsafe driving conditions caused by the weather, you may be able to extend your rental at no additional charge. Again, these extensions are subjective and we will expect to discuss them with you – at no time are you to assume you can keep the car.

FUEL POLICY

Renters are expected to refuel their rental vehicle before returning to Broadway SuperCars LLC. All vehicles MUST be fueled with Premium Grade 91+ octane gasoline. If the vehicle is refueled with anything but Premium Grade 91+ octane, they will be subject to a penalty fee. Lower fuel grades can severely damage the vehicle’s engine.

Additionally, if you decide not to return the car with a full talk of gas, you will be subject to a refueling fee, which will be taken from your deposit on file.

REFUND POLICY / MECHANICAL BREAKDOWN

We do our very best to work with our customers and want to make sure you are satisfied 100% with your driving experience. We do not offer refunds for gift certificates or vouchers purchased from any social media sources. Our weather policy (mentioned above) is one of two refund exceptions. The second is in the event of an unforeseen mechanical failure during or prior to a rental (driver must not be at fault). There’s a big difference between running the vehicle hard and abuse. We encourage all drivers to safely enjoy themselves and let the engine stretch its’ legs. But, If you are cruising at 9000 RPM’s for an hour without shifting and the car breaks down, you are most likely at fault. In the event of a not-at-fault breakdown, we will make every effort to get the car back on the road and/or will credit you for the time and miles you were not able to use by giving you the option to receive a pro-rated refund payment or credit towards a future rental.

DRIVING AREA RESTRICTIONS / PROHIBITED USES

Vehicles rented from our New Jersey office may not be driven outside the following states without prior written approval from Broadway Supercars LLC: New Jersey, New York, Massachusetts, Vermont, New Hampshire, Maine, Rhode Island, Connecticut, Pennsylvania, Delaware, Maryland and Virginia.

The vehicle is not to be used:

By unlicensed drivers, or drivers whose license has been suspended or restricted

For any illegal purpose or in connection with any illegal activity

To carry persons or property for hire (the vehicle cannot be sub-leased)

To push or tow anything

To teach anyone to drive

On any unpaved surface

In any speed test, contest, race, rally, demonstration, or on or near ANY AND ALL racetracks or road courses.

We are extremely serious about our no racetrack rule.No insurance company will cover the car while on a racetrack. If you violate this rule, please beware that you will be liable for covering 100% of the vehicle, should it be involved in any accident. If any of these prohibited uses are violated, we reserve the right to end your rental and retrieve the vehicle. Violations are also subject to forfeiture of 100% of the damage deposit – so please, follow these rules.

Vehicles rented from our New Jersey office may not be driven outside the following states without prior written approval from Broadway Supercars LLC: New Jersey, New York, Massachusetts, Vermont, New Hampshire, Maine, Rhode Island, Connecticut, Pennsylvania, Delaware, Maryland and Virginia.

TRAFFIC TICKETS

Drivers are responsible for all parking, traffic, speeding and/or other tickets or violations issued while the vehicle is being rented. Drives are responsible for paying all fees, penalties, towing charges, impound costs, and any other related costs incurred during their rental period. All traffic fines/penalties incurred by the renter during the rental period are subject to an administration fee of $200.

BREACH OF AGREEMENT

Breach of this agreement occurs but is not limited to when: The vehicle is not returned by the renter as specified; The vehicle is driven by a person not listed as an extra driver; The loss or damage or the event giving rise there to occurred in a situation where the vehicle is driven by any person without a valid driver’s license.

RESPONSIBILITY AFTER LOSS OR DAMAGE TO VEHICLE

The renter shall take every precaution to safeguard the interest of Broadway SuperCars LLC. If there is an incident during the rental period, the renter must do the following:

Notify Broadway SuperCars LLC within 32 hours of the incident

Obtain the names and addresses of everyone involved (if possible)

Release any party nor settle any liability claim against or by a third party

Notify the police within 24 hours of the occurrence in question

Complete and furnish to Broadway SuperCars LLC’s standard claim form within 24 hours of the occurrence

Make adequate provisions for the safety and security of the vehicle

Cooperate fully with Broadway SuperCars LLC and its insurer in all ways relating to the occurrence

The renter will be financially liable, as determinable based on the nature of the incident and damage incurred. Broadway SuperCars LLC will work closely with the renter’s insurance company to settle all accident claims to the satisfaction of Broadway SuperCars LLC.

NON-LIABILITY

Neither Broadway SuperCars LLC nor any of its members, employees, consultants, directors, owners or agents shall be liable for any loss or damage, whether direct or indirect, consequential or otherwise arising from the rental by the renter of the vehicle. This includes, and without limitation, any defect or mechanical failure of the vehicle or the failure of Broadway SuperCars LLC to detect defects or mechanical problems with the vehicle, and whether such loss or damage results from breach of contract.

Broadway SuperCars LLC, its members, employees, servants or agents are accordingly indemnified by the renter or his estate against any claim/s of any nature whatsoever and howsoever arising from any damages or loss which might be instituted against it, arising from the renting of the vehicle contemplated in these terms and conditions.

GOVERNING LAW

THESETERMS AND CONDITIONS, AND ALL TRANSACTIONS THEREIN, SHALL BE GOVERNED BY THE LAWS OF THE STATE OF NEW JERSEY, WITHOUT REFERENCE TO THE CONFLICTS OF LAW THEREOF AND THE PARTIES HEREBY CONSENT TO THE EXCLUSIVE JURISDICTION OF THE COURTS SITTING IN THE COUNTY OF CLIFTON, STATE OF NEW JERSEY TO ADJUDICATE ALL DISPUTES ARISING HEREUNDER.
